Can You Pass a School Bus in Florida?

Similar to other states, Florida restricts drivers from passing when a school bus has stopped in front of them. The purpose of these laws is to protect school children from being hit by speeding cars who are passing their school bus. Because the crime involves minors, the penalties for passing a school bus illegally are immense in Florida and much more serious than your average speeding ticket.  

Under Florida Statute Section 545.066, a motorist when approaching a school bus from either direction that is receiving or discharging a student must do the following:

  • Stop before reaching the school bus when the bus is blinking red lights and slow down if the bus is flashing yellow lights; and
  • May not proceed until;
    • The school bus resumes motion;
    • The driver is signaled by the school bus motorist to proceed; or
    • The yellow or red lights are no longer on

Drivers are not required to stop for a passing school bus if the vehicle is on a different roadway or if they are on a controlled-access highway. Failure to follow these laws will result in an automatic citation for passing a school bus illegally.

What Are the Penalties for Passing a School Bus in Florida?

Passing a school bus illegally will result in serious administrative penalties. The state of Florida has implemented abnormally large fines with school bus violations in an effort to protect school children from passing motorists. So, the fine for passing a school bus is much more than a standard traffic citation.

A first-time ticket for passing a school bus will result in a fine of $165. In addition, you will have a mandatory hearing to determine whether it’s necessary you should spend up to 6 months in jail. Admitting guilt to the citation will also result in four points being added to your license. You will also be required to attend a Driver Improvement Course on top of all these penalties. 

Receiving a second ticket for passing a school bus illegally within 5 years of the first offense will lead to a fine of $165 and an automatic license suspension for up to 6 months. It’s important to note that if you pass on the right side of the bus, the penalties are enhanced dramatically. 

Passing on the right side of the bus will result in a fine of up to $265 for a first offense. A second ticket for passing on the right side of a school bus within 5 years will lead to an additional $265 fine, license suspension for up to one year, required attendance to an Driver Improvement Course, and a mandatory hearing to determine if you should have your license revoked or not.
